MalFar Digital provides web development services including but not limited to:

2. Client Responsibilities
As a client, you agree to:

- Respond to our communications and feedback requests promptly
- Provide clear and constructive feedback during the review process
- Make payments according to the agreed schedule
- Ensure you have the rights to all content and materials you provide

3. Project Workflow
Discovery Phase
We begin with a discovery phase to understand your requirements, goals, and expectations. This includes initial consultations and requirement gathering.
Design & Development
We create designs and develop your solution according to the agreed specifications. You will have opportunities to review and provide feedback at key milestones.
Revisions
The number of revision rounds will be specified in your project agreement. Additional revisions beyond the agreed scope may incur extra charges.
Launch & Delivery
Upon completion and your approval, we will launch your project and provide all necessary documentation and training.
4. Payment Terms
- Pricing: All prices are quoted in USD unless otherwise specified
- Payment Schedule: Typically 50% upfront and 50% upon completion, unless otherwise agreed
- Payment Methods: Bank transfer, PayPal, or other agreed methods
- Late Payments: Overdue invoices may result in project suspension and additional fees
- Refunds: Refund policies will be outlined in individual project agreements
- Additional Work: Any work outside the original scope will be quoted separately
5. Intellectual Property Rights
Client Content
You retain all rights to content, text, images, and materials you provide. You grant us a license to use these materials for the purpose of completing your project.
Deliverables
Upon full payment, you will own the final deliverables created specifically for your project. This includes custom designs, code, and assets developed exclusively for you.
Third-Party Components
Projects may include third-party libraries, frameworks, or tools. These remain under their respective licenses. We will inform you of any licensing requirements.
Portfolio Rights
Unless otherwise agreed, we reserve the right to showcase completed work in our portfolio and marketing materials.
6. Confidentiality
We respect the confidentiality of your business information and will not disclose your confidential information to third parties without your consent, except as required by law or as necessary to complete your project.
For projects involving sensitive information, we are happy to sign a Non-Disclosure Agreement (NDA).
7. Project Timelines
We provide estimated timelines for project completion. Actual timelines may vary based on:
- Timely provision of content and materials from the client
- Response time to feedback requests
- Scope changes or additional requirements
- Technical complexities or unforeseen challenges
- Third-party dependencies
Delays caused by client factors will not affect our responsibility for timeline delivery.
8. Warranties and Disclaimers
Our Commitment
We commit to delivering services with professional skill and care. We warrant that work will be free from material defects for a specified period (typically 30-90 days) after delivery.
Limitations
We do not warrant that:
- Services will be uninterrupted or error-free
- Results will meet your specific business objectives
- Third-party services or integrations will remain available or compatible
- Future browser or technology updates won't affect functionality
9. Limitation of Liability
To the maximum extent permitted by law, MalFar Digital shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, revenue, or business opportunities
- Data loss or corruption
- Damages exceeding the total amount paid for the specific project
This limitation applies except in cases of willful misconduct or gross negligence.
10. Maintenance and Support
Post-launch support and maintenance services are available separately. Support terms include:
- Bug fixes for issues directly caused by our work
- Technical support for questions about functionality
- Updates and improvements as separate services
- Response times based on support tier selected
Ongoing maintenance packages can be arranged based on your needs.
11. Termination
By Client
You may terminate a project at any time by providing written notice. You will be responsible for payment of all work completed up to the termination date.
By MalFar Digital
We may terminate services if:
- You breach these terms
- Payments are significantly overdue
- You fail to provide necessary materials or cooperation
- The project becomes technically or legally unfeasible
12. Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, strikes, power failures, internet outages, or government actions.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of Pakistan. Any disputes shall be resolved through good faith negotiation or, if necessary, through the courts of Pakistan.
14. Modifications to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of our services constitutes acceptance of the modified terms.
Individual project agreements may contain specific terms that supersede these general terms.
15. Severability
If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms of Service, together with our Privacy Policy and any project-specific agreements, constitute the entire agreement between you and MalFar Digital regarding the use of our services.
